Data Accuracy: We expect Users to provide accurate and genuine information for all transactions conducted through our website. While we do not verify the data provided, we reserve the right to refuse service or terminate transactions if any User is found to have misrepresented or misused our platform.

Fair Usage: Users agree that our website is intended for legitimate purposes only. Any use of malicious code or deployment of bots is strictly prohibited. Users are responsible for ensuring the security of their browsers and operating systems.

User Responsibility: Users are solely responsible for the accuracy and validity of the information submitted via our website or any documents uploaded. We forward this information to relevant dealerships, third-party vendors, or government departments for transaction processing. Users indemnify Kavaerides against any losses or liabilities arising from false information or fake documents.

Transaction Mechanism: Our platform facilitates online transactions between customers and dealerships through our payment gateway partner. All payments made through the website are directed to the selected dealership, not to Kavaerides. Customer payment information is securely handled by the payment gateway and not shared with dealerships or Kavaerides.

By using our platform, you agree to abide by these terms and conditions. Kavaerides is committed to providing a seamless and secure experience for all our Users.

Third-Party Services: Kavaerides acts solely as a facilitator for the purchase and delivery of 2-wheeler vehicles. Ancillary third-party services such as insurance purchase, loan applications, surveys, and installation services are executed by respective third-party agencies or vendors, not by Kavaerides. Our role is limited to coordinating payments and deliveries.

Customers are free to opt out of any third-party services or choose alternative providers during service renewal.

Product Details: While we strive to provide accurate information, Kavaerides does not guarantee the accuracy, completeness, reliability, or timeliness of product names, descriptions, prices, images, or other content on the platform. Prices, schemes, and discounts mentioned are subject to change without prior notice. Customers are advised to verify product specifications and details at the dealership.

The product information on Kavaerides is for personal, non-commercial use only.

Online Booking/Pre-Booking/Registration of Interest: Kavaerides provides a platform for customers to view products, request test rides, book purchases, register for pre-booking, and express interest in products. The platform may undergo enhancements for improved customer experience.

During online bookings or accessing other services, customers must provide a One Time Password (OTP) verified mobile number and email address. These verified contacts are essential for communication from Kavaerides, selected dealerships, and authorized third-party partners such as insurance and finance services.

Customers must agree to provide acceptable identity and local address proof documents for RTO registration. Failure to provide these documents may result in booking cancellation, with applicable cancellation charges.

To initiate pre-booking online with Kavaerides, customers must agree to furnish acceptable identity proof and driving license documents for test ride registration. Failure to provide these documents grants Kavaerides the right to deny access to test rides or priority booking.

A booking is considered effective only upon the receipt of the specified booking amount paid by the customer through the online payment mode.

During online booking, if the booking amount is deducted by the customer’s issuer bank but not received by the payment service provider, the customer’s booking remains pending until payment is received. Failure to receive payment will result in the cancellation of the pending booking. Any deducted amount will be refunded within 7 working days through the same mode of payment used during booking. In such cases, customers can either rebook online or visit the dealership in person.

Upon request from Kavaerides or CTL/BAL, customers must present the booking details sent to their registered email address and mobile number for processing the booking.

Payment Policy: Customers must pay the booking amount for a vehicle and any final amount (including third-party services availed online) through the selected Payment Gateway. Additional payments, if any (for offline purchases or any differential amount during the final invoice), must be made directly by the customer to Kavaerides, as applicable. The amount for the selected vehicle will be displayed in the product details before making an online payment.

Payments made by customers for online booking are credited by the payment gateway service provider to Kavaerides directly, after deducting gateway charges and applicable taxes.

When customers make online bookings for Kavaerides, payments are adjusted in the final nett amount of the vehicle when making the final payment to the selected dealership.

The Payment Gateway may charge a specified fee for this service, and Kavaerides or its dealership holds no responsibility for any such charges levied by the Payment Gateway.

If money is deducted from the customer’s account during online booking, but the booking is not confirmed due to technical or unforeseen reasons, the deducted money will typically be refunded within 7 working days using the same mode of payment used during booking. If the refund is not processed by the issuer bank, the customer needs to follow up directly with their bank using the payment details shared through email by the payment gateway partner.

Kavaerides, its dealerships, and partner service providers do not receive or store payment details, including debit/credit card details or net banking details of the customer submitted through the payment gateway provided on the website.

Customers are allowed to change a booked Kavaeride to any other available vehicle within the same dealership where they made the original booking until they make the final nett payment to the dealership.

Once the final nett payment has been made by the customer to the selected dealership, either online or physically at the dealership, no modification or change in the booked vehicle shall be permitted.

If the booking amount for the changed Kavaeride is higher than the originally booked vehicle, the customer is required to make the additional payment online to confirm the modification of the booking. Only upon receipt of the additional payment by the selected dealership and upon email confirmation of the modification of the booking to the customer, the original booking shall stand amended.

If the booking amount for the changed Kavaeride is lower than the originally booked vehicle, the difference amount shall be adjusted by the selected dealership at the time of final nett payment.

Customers can cancel a Kavaeride booking until they make the final nett payment to the dealership. Once the final nett payment has been made, either online or physically at the dealership, no cancellation shall be permitted.

Customers must complete the purchase journey and take delivery of a Kavaeride within 60 days from the date of booking. Failure to make complete payment within 60 days shall lead to booking cancellation. Kavaerides and its dealerships reserve the right to cancel bookings at any point without prior notice to the customers.

Upon cancellation of a confirmed booking with Kavaerides, a cancellation charge shall be applied. The cancellation fee will vary depending on the chosen vehicle and will be clearly indicated at the time of booking as well as during the cancellation process. Kavaerides reserves the right to adjust these charges without prior notification.

For cancellations made within 60 days from the booking date, refunds will be automatically processed through the online system using the same payment method initially used for booking, after deducting applicable cancellation charges.

Refunds for cancellations within the 60-day period are typically processed within 7 working days by the issuing bank, using the same payment method as the booking. Should any issues arise with the refund process, customers are advised to contact their bank directly, using the details provided via email by our payment gateway partner.

Cancellations requested after 60 days from the booking date will necessitate manual processing by the dealership. In such cases, customers should directly liaise with the respective dealership where the booking was made for refund processing, which will not be conducted through the online system, except for the deduction of cancellation charges.

Document Verification and KYC:
Customers are required to submit KYC and related documents online. Following online submission, customers must visit the dealership for document inspection and verification necessary for vehicle registration and applicable subsidies.

Similar documentation may also be necessary for loan approval or other third-party services/products. By making an online booking, customers consent to Kavaerides sharing KYC details and other required documents with financiers or third-party service providers via digital platforms or physically, as required.

Scheduled Test Rides:
Test rides can be scheduled online at select dealerships for customer convenience. However, it should be noted that scheduled test rides are not contractual commitments, and the dealership reserves the right to deny or cancel them at their discretion, without providing reasons.

Scheduled dates for test rides are also not contractual commitments and may be subject to change or rescheduling at the dealership’s sole discretion.

Final Pricing, Product, and Invoicing:
Prices displayed on the website at the time of booking are subject to change. Kavaerides may offer schemes at specific locations for certain periods or products, and customers are advised to verify scheme eligibility/applicability with the respective dealership. The terms and conditions specified for any such schemes are applicable.

Customers can make the balance payment online or directly to the selected dealership, as applicable, at the time of invoicing. The balance payment receivable represents the on-road price after deducting the booking amount paid and adjusting the finance amount approved/received from the financer.

If a customer chooses to seek financing through offline financiers, they must directly submit the finance sanction letter to their chosen Kavaerides dealership. Upon approval at the dealership, the customer should then proceed to make the final payment either online or directly to the dealership.

The final invoice must accurately detail the ex-showroom price, insurance charges, finance charges (if applicable), RTO registration fees, smart card charges, government subsidies (if any), handling charges, or any other optional costs along with their respective taxes as of the invoice date.

The dealership will generate the final invoice once they receive the final nett payment equivalent to the on-road price of the vehicle. In case of any revisions in vehicle prices or unforeseen circumstances, the customer is responsible for any differential amount arising, which they should promptly pay.

Any variance between the amount paid by the customer and the invoiced amount by the dealership in the final invoice must be rectified either by the customer or the dealership, as necessary. The amount specified on the final invoice will be considered definitive, and the dealership retains the right to release the vehicle only upon receiving the final nett payment as per the invoice.

Kavaerides reserves the right to modify its products, including withdrawing them from the market, without prior notice to the customer. Customers have the option to change their selection to any other available product at the dealership or cancel the booking if desired.

Insurance:

  • Possession of a valid insurance policy is mandatory for purchasing a vehicle.
  • The provided content serves informational purposes only, and customers are free to choose their insurance policy.
  • Customers should not interpret any information or material as legal, tax, investment, financial, or any other form of advice.
  • The platform, operated by Chetak Technology Limited / Bajaj Auto Limited, or any third-party service provider, does not solicit, recommend, endorse, or offer to buy or sell any insurance policy.

Government subsidies, such as FAME-II/EMPS-2024, applicable to eligible vehicles and customers, will be adjusted in the customer invoice upon approval from respective government departments. Customers must declare their eligibility for subsidies upfront and comply with government requirements, including OTP verification of Aadhaar-linked phone numbers.

In case of subsidy rejection by the government, the dealership may reject subsidy documents or take a refundable deposit against the subsidy. If the government rejects the subsidy, the dealership may demand full payment of the subsidy amount from the customer.

For states where customers claim subsidies directly, necessary documents will be provided by the dealership during vehicle delivery, and customers must follow the process defined by respective state governments.

Any add-on products or services offered by CTL/BAL are voluntary, subject to withdrawal or amendment by CTL/BAL without prior notice. Customers must agree to the specific terms and conditions of add-ons before purchasing or using them.

Add-ons offered by authorized third-party partners are subject to their respective terms and conditions. Customers should confirm details with the dealership before purchasing any add-ons. CTL/BAL is not liable for any deficiencies in service or product arising from third-party add-ons.

Regarding extended warranty, customers must adhere to instructions in the User Manual and Warranty Policy, get the vehicle serviced/inspected at Chetak authorized service centers or dealers, use genuine spare parts recommended by CTL/BAL, and contact Chetak authorized dealer/service centers for any concerns or issues with the vehicle. Failure to comply with these conditions may result in the automatic extinguishment of the owner’s right to claim under the extended warranty.

Extended Warranty Guidelines

  1. Kavaerides assumes no liability for consequential loss or damage resulting from part failure. Delays in repair at the workshop do not warrant extension of the warranty period or entitle the customer to claim compensation.
  2. The dealer reserves the right to either repair or replace the defective part.
  3. To enjoy the benefits of the Extended Warranty, it is imperative to adhere to the vehicle’s periodic maintenance schedule as specified by the authorized Chetak dealer/service center.
  4. Any tampering with or disconnecting of the odometer/mileage recorder will result in claim refusal.
  5. The Extended Warranty does not cover vehicles used for competitions, races, record-setting attempts, or commercial purposes such as taxis.
  6. Any tampering, alteration, replacement, or repair of vehicle parts/assemblies at workshops not authorized by Chetak will void the warranty.
  7. In case of an accident, the Extended Warranty ceases to apply to affected parts. However, once replaced, the warranty continues until its expiration.
  8. Any vehicle breakdown not towed on a flatbed is against policy and renders the warranty inapplicable.

Extended Warranty does not apply to:

  1. Normal maintenance operations such as brake adjustments, suspension tweaks, and minor adjustments.
  2. Parts subject to normal wear and tear, including brake discs, brake pads, fork oil seals, bearings, tires, and auxiliary batteries.
  3. Failure of the vehicle onboard charger due to overvoltage, voltage fluctuations, or improper grounding at the charging point.
  4. Replacement of rubber components and electrical items for aesthetic purposes.
  5. Painted parts: Defects arising from external damages, use of protective covers/coatings, or adverse atmospheric conditions.
  6. Cost of consumables such as gear oil, fork oil, brake oil, and grease, which are the responsibility of the customer.
  7. Damage to the motor, battery, or any other component due to water ingress while driving through flooded areas.
  8. Rust or corrosion of chrome-plated parts in coastal or acidic environments.
  9. Oxidation of unpainted/painted parts in acidic environments or coastal areas.
  10. Normal service/maintenance activities and natural wear and tear.
  11. Misuse, accidents, negligent treatment, or use of unauthorized parts/equipment.
  12. Alteration, modification, or unauthorized replacement of vehicle parts affecting performance and reliability.
  13. Failure to adhere to recommended inspection and servicing intervals at authorized Chetak dealers/service centers.
  14. Failure arising from the use of non-recommended battery chargers.
  15. Repairs and adjustments due to improper maintenance, lack of required maintenance, or misuse of electric components.
  16. Damage due to accidents, acts of God, or cosmetic corrosion.
  17. Use of non-genuine/recommended parts or modifications.
  18. Defects caused by corrosion, overheating, freezing, abuse, or lack of timely servicing.
  19. Damage due to vandalism, riots, terrorism, natural calamities, or animal/insect intrusion.
  20. Any tampering with the odometer/mileage recorder or vehicle parts/assemblies.
  21. Vehicle breakdowns not towed on a flatbed, against warranty policy.

Kavaerides Warranty and Customer Service Agreement

Limited Warranty for Kavaerides Batteries: Kavaerides batteries are covered against manufacturing defects and abnormal drops in Ampere-hour (AH) values. However, normal deterioration in performance over time is not covered under warranty. The warranty also does not extend to failures resulting from accidental damage, misuse, or improper care of the batteries. Warranty coverage will cease if scheduled service, as outlined in the Owner’s manual, is not performed. Battery capacity naturally diminishes with time and usage, considered normal wear and tear. Warranty covers repair or replacement if battery degradation falls below 60% of the original capacity/performance.

Vehicle Registration, Delivery, and After Sales Service: Upon completion of online booking and payment, the subsequent processes, including vehicle registration, delivery, and after-sales service, are handled by the selected dealership. Kavaerides Technology Limited (KTL) or Bajaj Auto Limited (BAL) are not liable for any deficiency in service or product after this stage. The customer is responsible for providing acceptable local address proof for registration. Failure to provide complete and acceptable documents may result in booking cancellation, with applicable charges retained. Delivery is at the dealership premises, with the customer responsible for transportation arrangements. After-sales service is available at listed dealerships, with the customer required to bring the vehicle to the service facility at their expense.

Connected Vehicle Data: Kavaerides vehicles may feature connected technology, transmitting machine-related data through an M2M SIM. Personally identifiable customer data is stored in compliance with government guidelines. Data collection aims at product development, improvement, and warranty compliance. Data handling complies with KTL/BAL’s Privacy Policy, subject to regulatory obligations. Access to relevant data and add-on services may incur charges, with subscription terms specified.

Manual Booking: Customers may opt for manual booking at preferred dealerships, with transactions conducted offline. Only online booking is permitted for Kavaerides products, with customers responsible for accurate information and documentation.

Vehicle Resale: In case of vehicle resale, the previous owner must inform the new owner to validate the purchase and complete KYC verification at the nearest dealership. Until ownership transfer is completed, the previous owner retains access to Chetak App features. KTL/BAL and their dealerships are not liable for information breaches or app unavailability during ownership transition.

Dispute Resolution, Applicable Law, and Jurisdiction: Disputes arising from website bookings are subject to KTL/BAL’s company policy, with exclusive jurisdiction in Pune, Maharashtra. Terms of Use are governed by Indian law.

Indemnity: Users agree to indemnify and hold harmless KTL/BAL and affiliates from any claims arising from website access, services, or product use.

Liability: Users acknowledge the risk associated with website use and product purchases, with CTL/BAL’s liability limited to the cost of the product or actual damages incurred.

Force Majeure: Neither party is considered in breach of the agreement due to Force Majeure events, preventing performance of obligations.
